随着经济的全球化和我国加入WTO，我国的金融业面临着越来越激烈的国际竞争，金融控股公司是我国目前在分业经营与监管的金融体制下逐步走向混业经营的现实选择。目前我国的金融控股公司在组建和经营过程中存在诸多不规范不完善之处，并且，隐含着较大的潜在风险。本文第一章从金融控股公司的概念入手，介绍了国内外关于金融控股公司的不同定义和几种不同的分类方法；第二章从市场失灵论和信息不对称理论阐述对金融控股公司进行法律规制的理论基础；第三章分别介绍了美国、英国、日本、韩国以及我国台湾地区关于金融控股公司的立法，分析了这些国家和地区对金融控股公司法律规制的成功经验；第四章结合我国目前金融控股公司的发展现状分析了其所存在的潜在风险；第五章分析了我国金融控股公司法律规制缺位的成因，并从八个方面对我国金融控股公司法律规制的构建提出了建议。
